Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the AIGC Motion website, platform, applications, features, products, and services (collectively, the “Services”).

By creating an account, accessing, purchasing, or using the Services, you agree to be bound by these Terms, together with our Privacy Policy and any other policies or rules expressly incorporated into these Terms.

1. About AIGC Motion

AIGC Motion is an artificial intelligence content-generation platform that may provide AI Chat, AI Image Generation, AI Video Generation, AI Voice Generation, AI Music Generation, Generation History, Credit management, Cloud media storage, Content playback and download, Personalisation, and other AI-powered features.

2. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to use the Services. You represent that the information you provide is accurate, you will comply with applicable laws, you have authority to use your account, and you have all necessary rights and permissions for content you upload or submit.

3. Account Registration

You are responsible for maintaining accurate account information, keeping your login credentials secure, preventing unauthorised access to your account, and all activities carried out through your account subject to applicable law.

4. AI Services

AIGC Motion provides access to AI-powered generation tools. AI-generated outputs may be inaccurate, incomplete, inconsistent, unexpected, unsuitable for a particular purpose, similar to outputs generated for other users, or affected by limitations of the underlying AI model.

AI systems do not guarantee that generated content will be factually correct, original, error-free, or suitable for your intended use. You are responsible for reviewing generated content before using, publishing, distributing, or relying on it.

5. No Professional Advice

The Services are not intended to provide professional advice. AI-generated information must not be treated as a substitute for legal, medical, financial, accounting, investment, safety, or other regulated professional advice.

6. User Prompts and Inputs

You may submit prompts, instructions, text, settings, files, reference media, voice recordings, and other information (“User Inputs”). You remain responsible for your User Inputs and represent that you have the necessary rights, permissions, licences, and authorisations to submit them.

7. Uploaded Images, Videos and Audio

You are responsible for ensuring that you have all necessary permissions to use uploaded content. You must not upload another person's photograph, video, voice recording, personal information, identity document, private communication, or confidential material without an appropriate legal basis, permission, or other authorisation.

8. User Content Rights

You retain your rights in User Inputs, subject to rights granted to us and our service providers as necessary to provide the Services. You grant AIGC Motion a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, process, transform, and otherwise use User Inputs only as reasonably necessary to provide, secure, maintain, and legally operate the Services.

This licence does not give AIGC Motion ownership of your User Inputs.

9. Generated Content

Subject to applicable law, third-party provider terms, and the limitations described in these Terms, AIGC Motion does not claim ownership of content generated for you solely because you generated it using the Services.

AI-generated content may not be legally protected by copyright in every jurisdiction, similar content may be generated for different users, third-party providers may impose additional terms, and generated content may contain errors or resemble existing works.

10. Intellectual Property

The AIGC Motion platform, including its software, source code, user interface, design, branding, logos, trademarks, documentation, platform structure, system architecture, and non-user-generated content is owned by or licensed to AIGC Motion and protected by applicable intellectual property laws.

11. Prohibited Uses

• Breaking applicable laws or regulations
• Committing fraud
• Facilitating criminal activity
• Circumventing security controls
• Attacking or disrupting our infrastructure
• Uploading malware
• Attempting unauthorised access
• Reverse engineering the platform
• Abusing API endpoints
• Circumventing credit or rate limits
• Creating multiple accounts to evade restrictions
• Abusing free usage mechanisms
• Reselling or sharing account access without authorisation
• Unauthorised scraping
• Generating or distributing content that violates law or third-party rights
• Attempting to bypass AI provider safety controls
• Using generated content to impersonate, deceive, defraud, threaten, harass, or unlawfully harm others

12. Real Persons, Likeness and Voice

Where the Services allow image, video, or voice generation involving identifiable persons, you are responsible for obtaining all necessary rights, permissions, releases, and consents. You must not use the Services to unlawfully impersonate another person, exploit another person’s likeness, replicate another person’s voice without appropriate authorisation, or create deceptive or fraudulent representations.

13. AI Provider Safety Systems

Certain AI generation requests may be rejected by third-party providers because of safety, security, technical, or content policies. You must not attempt to circumvent provider safety systems.

14. Service Availability

We aim to provide reliable access to the Services, but we do not guarantee that the Services will always be available, uninterrupted, error-free, secure, free from delays, compatible with every device, or available for every AI model or feature.

15. Third-Party AI and Infrastructure Providers

Some Services depend on third-party providers of AI models, cloud infrastructure, storage, authentication, email, payment processing, analytics, or security services. Third-party providers may change, discontinue, restrict, or modify their services.

16. Credits

Certain Services operate using credits (“Credits”). Credits may be used for eligible AI generation and platform features according to the pricing rules displayed by AIGC Motion. Credits are not cash, not a bank balance, cannot ordinarily be exchanged for cash, transferred between accounts, or resold.

17. Free Credits and Free Usage

AIGC Motion may provide promotional Credits, new-user Credits, daily free usage, or other free benefits. Free benefits may be subject to eligibility rules, limits, expiration periods, or anti-abuse controls.

18. Credit Reservation and Failed Generations

For certain generation requests, Credits may be temporarily reserved before generation is completed. Where a generation ultimately fails and our system determines that the request did not successfully produce the requested result, the reserved Credits may be refunded or released in accordance with our billing system.

19. Credit Packages and Purchases

Current or promotional Credit packages, quantities, and prices are displayed on the Services at the time of purchase. Package names, Credit amounts, prices, and availability may change.

Purchased Credits are valid for the configured validity period shown by AIGC Motion at the time of purchase and expire at the end of the stated expiry date. Unused Credits remaining after the expiry date will no longer be available for use, subject to applicable law and any specific promotional terms.

20. Payments

Payments may be processed through third-party payment providers. You agree to provide accurate payment and billing information. AIGC Motion may not store full payment card details where those details are processed directly by the payment provider.

21. Refunds

Unless otherwise required by applicable law, purchases are generally intended to be final once Credits have been delivered to your account.

• Payment charged but Credits not delivered
• Duplicate charge
• Confirmed system error causing an incorrect charge
• Generation failure resulting in incorrectly consumed reservation
• Refund required by applicable law
• Refund expressly provided under a separate refund policy

22. Subscription Services

If AIGC Motion later offers subscription plans, additional subscription terms may apply, including billing frequency, renewal rules, cancellation rules, subscription benefits, usage limits, Credit allocation, and trial periods.

23. Taxes and Charges

You are responsible for taxes, duties, fees, or other charges that may apply to your purchase or use of the Services, except taxes that AIGC Motion is legally required to collect and remit.

24. Generation History and Stored Content

AIGC Motion may store generation history and related media to provide history browsing, prompt restoration, settings restoration, playback, downloads, and content management. You should maintain your own backups of important generated content.

25. Content Removal

We may remove, restrict, disable access to, or refuse to process content where reasonably necessary to comply with law, protect users, protect our infrastructure, enforce these Terms, respond to valid legal requests, address abuse or security concerns, or comply with third-party provider requirements.

26. Account Suspension and Termination

We may suspend or terminate access where reasonably necessary because of material breach, fraud, Credit abuse, unauthorised access, circumvention of security controls, illegal activity, repeated violation of safety rules, or conduct that materially threatens the Services or other users.

27. Effect of Termination

After account termination, access to the Services may cease, remaining Credits may become unavailable, generation history may become inaccessible, and stored files may eventually be deleted according to our retention policies.

28. Privacy and Personal Data

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, process, store, disclose, and protect personal data.

29. Confidentiality

If you use AIGC Motion for business or confidential purposes, you should avoid submitting confidential information unless it is necessary and you understand the relevant processing arrangements.

30. Third-Party Terms

Certain Services may be subject to additional terms imposed by third-party providers. Where applicable, you agree to comply with those additional terms.

31. Beta, Preview and Experimental Features

AIGC Motion may offer beta, preview, experimental, or newly released features. Such features may change frequently, have limited availability, contain errors, or be discontinued.

32. Feedback

If you voluntarily provide feedback, suggestions, ideas, bug reports, or recommendations, you grant AIGC Motion the right to use that feedback for improving and developing the Services without obligation to compensate you, provided that such use does not improperly disclose your personal data or confidential information.

33. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis. AIGC Motion does not guarantee that AI outputs will be accurate, unique, suitable for publication, or free from third-party rights, or that the Services will always be uninterrupted.

34. Limitation of Liability

To the maximum extent permitted by applicable law, AIGC Motion and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from your use of the Services.

Nothing in this section excludes or limits liability that cannot legally be excluded or limited under applicable law.

35. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless AIGC Motion and its officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, User Inputs, infringement of third-party rights, misuse of generated content, or violation of applicable law.

36. Force Majeure

AIGC Motion will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, power failures, internet failures, cyberattacks, cloud provider failures, AI provider outages, payment provider failures, telecommunications failures, labour disputes, or other extraordinary events.

37. Changes to the Services

We may add or remove features, modify interfaces, change generation models, change usage limits, change pricing, change Credit costs, replace third-party providers, suspend features, or discontinue features.

38. Changes to These Terms

We may update these Terms from time to time. When changes are made, the updated version will be published with a revised “Last Updated” date. Where required by law, we will provide additional notice for material changes.

39. Governing Law

These Terms are governed by the laws of Malaysia. Subject to any mandatory consumer protection rights applicable to you, disputes arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the courts of Malaysia.

40. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

41. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

42. Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and AIGC Motion regarding your use of the Services.

43. Assignment

You may not transfer or assign your account or rights under these Terms without our prior written consent, except where such restriction is prohibited by applicable law. AIGC Motion may transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar business transaction, subject to applicable law.

45. Acceptance

By registering for an account, purchasing Credits, accessing, or using AIGC Motion, you confirm that you have read these Terms, understand these Terms, agree to comply with these Terms, agree to our Privacy Policy, and have the necessary rights and authority to use the Services and submit your User Inputs.
